MenCell Delhi: Advocate ने आपका Recovery Claim ही खरीदने की Deal कर ली?
सोचिए आपने किसी से ₹20 लाख recover करने का case लगाया है।
आपका Advocate कहता है:
“आप मुझे अभी ₹5 लाख दे दीजिए, बाकी recovery मैं देख लूंगा… जो claim है उसमें मेरा भी हिस्सा रहेगा।”
यहीं रुककर सवाल पूछिए।
क्या आपका Advocate आपके pending recovery claim में खुद financial interest ले सकता है?
Bar Council of India Rules का Rule 21 कहता है कि an Advocate shall not buy, traffic in, stipulate for, or agree to receive any share or interest in an actionable claim.
और यह केवल “success fee” वाली बात नहीं है।
एक actionable claim broadly ऐसे unsecured debt या certain beneficial interest से जुड़ा claim हो सकता है जिसे law civil courts के जरिए enforce करने योग्य मानता है. Transfer of Property Act की Section 136 भी legal practitioners को ऐसे actionable claims में interest लेने से रोकती है.
मतलब Delhi-NCR में अगर आपका lawyer किसी recovery, compensation या debt claim को देखकर यह कहे कि:
“Case मैं चला दूंगा, लेकिन claim में मेरा हिस्सा रहेगा”
तो सिर्फ verbal promise समझकर आगे मत बढ़िए।
Written fee agreement मांगिए।
Claim की nature समझिए।
Payment और proposed interest का exact structure लिखित में लीजिए।
Supreme Court ने Bar Council of India v. A.K. Balaji में Rule 21 को litigation funding और champerty/maintenance जैसे arrangements के संदर्भ में भी discuss किया है.

अगर कोई advocate आपके claim को सिर्फ professional fee की तरह नहीं, बल्कि अपने financial stake की तरह देख रहा है, तो मामला समझे बिना sign या payment करना बाद में serious complication पैदा कर सकता है।
Caution: हर fee arrangement automatically Rule 21 violation नहीं बनता। पहले यह देखना जरूरी है कि transaction वास्तव में “actionable claim” है और Advocate ने उसमें किस प्रकार का interest लिया या लेने पर सहमति दी है।
Urgent legal situation में पहले facts और documents की proper review कराइए। बाद में नुकसान control करना कठिन हो सकता है।
